This site (the "Site") is owned and operated by the National Jewish Outreach Program ("Shabbat Across America 2.0") for your personal entertainment, information, education, and communication. You understand that Shabbat Across America 2.0 may modify, alter, or otherwise update these Terms from time to time without giving you any notice. This site is intended for a Jewish audience. Jewish people and organizations are welcome. However, NJOP reserves the right to remove any person, group or organization for any reason it deems valid. Examples include but are not limited to those that NJOP deems antithetical to the interests of the Jewish community, those whose mission it is to convert Jews to another religion or those who promote hatred towards any person or group;
Usage of Web Space Storage:
Shabbat Across America 2.0 provides members with free web space for their member postings. Free Web Space, as defined by Shabbat Across America 2.0, is comprised of hypertext mark-up language (html) and associated files, intended solely for the visual presentation of SHABBAT AND JEWISH-RELATED CONTENT on the members' pages. The spirit of free web space is specifically not intended as a storage facility for members' personal digital files. Using it as such is a violation of this Terms of Service Agreement. Also please note that pictures are only saved for the purposes of display on Shabbat Across America 2.0 and not for storage or other purposes. Members cannot assume that Shabbat Across America 2.0 will preserve the quality or resolution of any picture uploaded to Shabbat Across America 2.0.
Conduct of Members and Visitors.
We believe that all members and visitors benefit from basic rules regarding conduct while using the Services. Accordingly, we ask you-and you agree-to follow the following basic rules of conduct when using the Site:
You will follow these Terms and all applicable laws;
You will not harass, threaten, or abuse other people when using the Site in any manner;
You will not post or otherwise make available any Member Content that is obscene or may be hateful or offensive on racial, ethnic, sexual, or any other grounds; is harmful, vulgar, or distasteful; or is defamatory, libellous, or invades another person's privacy or proprietary rights;
You will not harvest any screen names or email addresses for any commercial use;
You will not collect or store personal information about any other individual on the Site, or otherwise stalk, repeatedly contact, or harass another user;
You will not impersonate any other person or misrepresent a relationship with any person or entity, including misrepresenting a relationship with Shabbat Across America 2.0; similarly, you will not adopt a false identity if the purpose of doing so is to deceive or defraud another;
You will not use the Services to harm children or minors in any way, or encourage inappropriate interactions with children or minors of any kind;
You will not manipulate the Services so as to hide your identity or participation in the Services on the Site (by using another person's identity, changing headers, or otherwise modifying any other possible identifiers);
You will not post any Member Content that contains any viruses, cancel bots, Trojan horses, harmful code, or other computer software or program designed to interrupt the Services we provide, users' ability to enjoy the Services, or the proper functioning of any software, hardware, or equipment or materials used in connection with the Services;
You will not send any bulk unsolicited advertising, promotional information, email or other solicitation (including without limitation junk mail, "spam," chain letters or pyramid schemes of any sort) to any person through the use of the Services;
You will not post or otherwise make available any Member Content you do not have the lawful right to post or to make available; and
You will not violate any international or US federal or state law.
If you violate any of the guidelines set forth above, or any other aspect of these Terms, we reserve the right to suspend or terminate your rights to use the Services without giving you any notice.
Indemnity.
You understand that you are personally responsible for your behavior while on the Site and agree to indemnify and hold Shabbat Across America 2.0 and its affiliates and their officers, directors, employees, and agents harmless from and against any loss, damage, liability, cost, or expense of any kind (including attorneys' fees) that we may incur in connection with a third party claim or otherwise, in relation to your use of the Services or access to the Site, or your violation of either these Terms or the rights of any third party.
Meetings at Venues
Through our Platform we provide tools that enable our users to arrange physical meetings, like Shabbat dinners, at venues that include, but are not limited to, public places, private homes or private enterprises (such as coffee shops or retail stores). We do not supervise these gatherings and are not involved in any way with the actions of any individuals at these gatherings. As a result, we have no control over the identity or actions of the individuals who are present at these gatherings, and we request that our users exercise caution and good judgment when attending these gatherings.
Release.
Because we do not supervise or control the gatherings or interactions among and between members and other persons or companies, and because we are not involved in any way with physical transportation to or from these gatherings or with the actions of any individuals at these gatherings, and because we cannot guarantee the true identity, age, or nationality of Platform users, and because we have very limited control, if any, over the quality, safety, morality, legality, truthfulness or accuracy of various aspects of the Platform, you agree that you bear all risk and you agree to release us (and our officers, directors, shareholders, agents, employees, affiliates, subsidiaries, and third party partners) and SHABBAT ACROSS AMERICA 2.0 organizers and their designees from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, now and in the future, arising out of or in any way connected with your use of the Platform, our resolution of any disputes among users, and/or your transportation to or from, attendance at, or the actions of you or other persons at, a SHABBAT ACROSS AMERICA 2.0 gathering. You further waive any and all rights and benefits otherwise conferred by any law of any jurisdiction that would purport to limit the scope of a release or waiver. You waive and relinquish all rights and benefits which you have or may have under Section 1542 of the Civil Code of the State of California or any similar provision of any other jurisdiction (including without limitation the states of Missouri, Delaware and Pennsylvania) to the full extent that you may lawfully waive all such rights and benefits.
